We (the GASPARE CORP) ("GASPARE") manage and or operate a number of services, including the Chocoville store located at Chocoville.com and the Gaspare.com website. If you believe content onchocoville.com or other GASPARE services infringes one or more of your copyrights, kindly send us a document comprising you notice ("DMCA Infringement Notice") and include the information requested below in the DMCA Infringement Notice template.

REGARDING MODELS: (1) All models you see on Chocoville.com and Gaspare.com and our other services have signed model releases, if you believe you are pictured at a party or sampling or otherwise tasting Gaspare chocolate goodies wherever and have not signed a model release we want to correct that matter. Please use the DMCA procedure listed on this page to contact us. (2) If you would like to be a model for our store and products please contact Gaspare, the people you see here in the store all loved being models, at least that's what they told us when while we were giving them chocolate.

We are very keen on protecting the copyrights of all parties, including our own, on the services we provide. To this end we will do what we can to keep things fair. We may contact and or take action against third parties who infringe, if we do so relying upon a DMCA Infringement Notice sent to us by you then you are responsible if your DMCA Infringement Notice is inaccurate.

When a copyright owner informs us via a DMCA Infringement Notice (see below for our template) that a third party actor has infringed on the copyright owner's copyright we will disable the alleged infringing content. We will also follow the procedure for notifying the poster of the allegedly infringing content and allow that party to submit a counter claim.

Description of the process for filing a DMCA Infringement Notice and what happens with copyright claims:

Before sending us a DMCA Infringement Notice or any copyright claim please consider the following, we suggest this respectfully as it will likely save us both time and money as well as not make problems for a possibly innocent third party contributor of content (you would expect the same fair treatment, correct?):

• In the event you are not certain the content appearing on a GASPARE service infringes your copyright, you should consider first contacting an attorney to help you determine if the DMCA Infringement Notice you intend to file is justified. The reason for this is to not make legal costs for yourself in the event a DMCA Infringement Notice you send us is frivolous, in bad faith or otherwise wasting our time as well as not to cause us expense or for us to cause expense for or bother a third party.
• We take DMCA Infringement Notices seriously, as do the courts. You will be liable for costs and damages (including but not limited to costs and attorneys' fees) if you materially misrepresent any aspect of an infringement claim.
• We may also publish any DMCA Infringement Notice and cover letters we receive, we reserve the right to annotate and excerpt any such documents.
• When you send us a DMCA Infringement Notice regarding allegedly infringing content posted to one of our services by a third party we will make a good-faith attempt to contact the third party poster so that they may make a counter notification. The method we will use to contact such a third party is the email address provided to us by that third party, if any.
• If you believe it is not a third party and it is us who posted infringing content we will make a good faith attempt to review your claim expeditiously.

The following is the DMCA Infringement Notice Template, include all the specified items in any DMCA Infringement Notice you submit to us in order for us to consider it a valid claim:

If a DMCA notice is valid, we are required by law to respond to it by disabling access to the allegedly infringing content.

Include all of the following (to expedite our ability to process your request, please use the following format including sections "step" numbers) in the written and signed document you send to us or your DMCA Infringement Notice will be deemed invalid:

1. Your name, address, telephone number and email address;
2. A definition of the type of content (i.e., image, video, text) you are claiming is being infringed;
3. A clear identification of the copyright claimed to have been infringed (i.e., The copyrighted item is "the item name");
4. The name of the GASPARE service where your claimed infringement is occurring;
5. The Uniform Resource Locator (URL), and exact location of the content you are claiming infringes on your copyright and other details you feel will help us identify the claimed infringing content;
6. Read, understand and include the following statements:
   • "I have a good faith belief that use of the copyrighted materials identified and described above as allegedly infringing is not authorized by me the copyright owner, the copyright owner's agent, or the law.";
   • "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner and that the copyright infringement I describe above it fully truthful and accurate."
7. Sign your DMCA Infringement Notice directly below the two statements in the previous step.

For third parties to whom we have forwarded a DMCA Infringement Notice and or disabled content you posted:

We are required by law to respond to valid DMCA Infringement Notices by disabling access to the allegedly infringing content. If you have posted content that has been disabled or receive from us a DMCA Infringement Notice we received that identifies content you posted you have the option to send us a counter-notice ("Counter Notice") stating why the content you posted does not infringe a third party's copyrights. If you decide to send us a Counter Notice please send it to the postal or facsimile (fax) address as at the top of this page and include the following or your Counter Notice will be deemed invalid:

1. Your name, address, telephone number and email address;
2. The name of the GASPARE service from which your content was removed, including the Uniform Resource Locator (URL);
3. A statement by you that under penalty of perjury, that you believe the content was removed by mistake or misidentification and why you believe so.
4. Read, understand and include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the content identified in the DMCA Infringement Notice was removed or disabled by GASPARE CORP as a result of a mistake or misidentification of the content, or that the material identified by the DMCA Infringement Notice is not copyrighted or my use falls under the "fair use" provisions of copyright regulation in my and GASPARE CORP's jurisdiction(s)."
5. Sign your Counter Notice directly below the statement in the previous step.
